Making sense of employment compliance in California is truly like going through a LABYRINTH. If you're supervising employees or oversee the HR functions in a business you will find yourself forced to enter the labyrinth. And once you enter you will most likely get lost in the corridors of laws and regulations. It's virtually impossible for anyone other than compliance experts to make it out safely.

Internet searches, YouTube videos, and the ocean of information available from HR organizations don't make it easy to put ALL of the compliance pieces together. It's like the alphabet. You might get piece A, piece B, and then miss piece C. Then you might find compliance piece D and miss pieces E and F and on and on.

As reported in June 2019, in a lawsuit involving one employee, in a case involving age and disability discrimination claims, as well as alleged retaliation and hostile work environment,

Jack in the Box was ordered to pay $15,400,000 to the employee in 2019!

Because every year the labyrinth keeps getting bigger and more confusing when the legislators in Sacramento add more to the existing confusing and complicated pages of laws and regulations. What makes it worse for business owners is that every year employees are getting smarter about how to file claims and lawsuits. But there's more. What also makes it especially worrisome is there are attorney's who know business owners don't have a clue how to get FULLY compliant and they know what to look for to immediately tell if an employee can win in court. HR managers are not immune either. Most don't have the training to cover all the ABCs of California compliance.
You need a guide who has navigated the California compliance labyrinth many times over and who has helped MANY business owners safely navigate the labyrinth. In fact, there's a reason HR professionals working in companies come to me to train them. Because even HR professionals sometimes need a guide getting through the labyrinth SAFELY. 

This is key because a good guide will help you save a ton of time, a ton of money, and the headaches that come along with figuring things out by trial and error. If You Aren't 100% Sure If You're California Compliant, You're More Than Likely Not And Already Exposed To HUGE Liability & Risk
On top of the long list of attorney's who hunt for employees who can sue their bosses and the companies they work for, there are state websites that actually HELP employees learn how to file claims and litigate!
You had better be using 1099's the correct way or it could be a nightmare for your business. For example, if you have even one 1099 "Independent Contractor" working inside of your brick and mortar location under certain circumstances if they get hurt while one the job your business could be shut down if the state considers them an "employee." This means that if you're using 1099 workers that should be converted into employees it's in the interest of the business to invest in compliance from the start. 

January 1, 2020, new Labor Code section 2750.3 makes clear that the ABC Test for independent contractors applies to all provisions of the Labor Code, the Industrial Welfare Commission’s Wage Orders or the Unemployment Insurance Code unless those provisions discussing an “employee” specifically contain an alternative definition. Thus, an individual providing labor or services shall be considered an employee absent all of the following “ABC” factors being met:  
  • (A) the person is free from control and direction of the hiring entity in connection with the performance of the work, both under the contract for the performance of the work and in fact;
  • ​(B) the person performs work that is outside the usual course of the hiring entity’s business; and 
  • ​(C) the person is customarily engaged in an independently established trade, occupation, or business of the same nature as that involved in the work performed.
AB 5 also contains many significant potential exceptions from the ABC Test, so it's very important that the business owner or operator understand the code and its impact on their business model. Numerous businesses using an independent contractor model (including some gig-economy businesses) have had to change their business structures to meet this new statute.
AB 5 also states that its provisions, including the potential exceptions from the general application of the ABC test, shall not permit an employer to reclassify anyone from an employee to an independent contractor as of January 1, 2019.

Lastly, and most concerning, AB 5 authorizes particular law enforcement officers (e.g., the Attorney General and some city attorneys) to pursue injunctive relief “to prevent the continued misclassification of employees as independent contractors.” Thus, in addition to the significant monetary liability flowing from misclassification, this provision seemingly potentially permits the State of California to force non-compliant employers to reclassify independent contractors as employees.
This means if you're using 1099 Independent Contractors in your business who should be classified as "Employees" now is the time to reclassify them and to put California HR compliance in place.
And for all employees, 3 things you might not have thought of for your business are these: 1) It only takes one negative interaction to turn a good employee into an OPPORTUNISTIC EMPLOYEE. And once they turn to the "dark side" they can covertly position themselves to walk away with a ton of money from your business. 2) If you're business is already not compliant, even if you've never had a problem with an employee, your business is like a ticking time bomb just waiting for an employee to trip the wire. 3) There are predatory attorneys in California who hunt for employees who have strong cases against non-compliant businesses even when no problems exist.

I have never met one business owner who ever enjoyed diverting their precious and EXTREMELY LIMITED TIME from making money to figuring out how to get their business compliant in California. Especially when they end up spending tons of time and money trying to figure things out only to end up in the same place they started where they have to find someone to help them. The same sentiment is always expressed to me. They can't get the time back and they feel like all the money they could have been making instead was washed down the drain.

When I first started developing the Compliance Accelerator it was clear, certain forces didn't want me to get this information into the hands of business owners and HR managers. Why? In the recent case, Bernstein v. Virgin America, Inc., N.D. Cal., No. 15-cv-02277, 1/16/19, the judge has ruled that Virgin America Inc. and Alaska Airlines Inc. must pay $77 million to a class of flight attendants who alleged a number of California wage violations including that they didn’t receive pay for all of their hours or breaks required by state law.
